By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.
We reserve the right to update or modify these Terms at any time. Your continued use of the Service following any changes constitutes acceptance of those changes.

All payments are processed securely through Paddle, our third-party payment processor. By making a purchase, you agree to Paddle's terms and conditions. We do not store your payment card information.
4.3 Taxes
You are responsible for any applicable taxes, duties, or government charges related to your purchase, except for taxes based on our net income.
4.4 Price Changes
We reserve the right to change our pricing at any time. However, price changes will not affect users who have already purchased access to the Service.

You agree that your User Content will not:
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
- Contain nudity, pornography, or sexually explicit material
- Contain hate speech, violence, or discriminatory content
- Contain malicious code, viruses, or harmful software
- Violate the privacy rights of others
We reserve the right to remove any User Content that violates these standards or is otherwise objectionable, at our sole discretion.
6.3 Our Intellectual Property
All content and materials available through the Service, including but not limited to text, graphics, logos, video tutorials, AI models, software, and code (excluding User Content), are the property of Image LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of our AI models, unless explicitly permitted by law.

- Impersonate or attempt to impersonate Image LLC, our employees, or other users

- Reverse engineer, decompile, or disassemble our AI technology
- Share your account credentials with others or create multiple accounts
- Use the Service to harass, abuse, or harm others
- Upload malicious code or attempt to compromise our security
- Use the Service for any commercial purpose without our written permission
Violation of this Acceptable Use Policy may result in immediate termination of your account without refund.
8. Disclaimers and Limitations of Liability

PhotoGuru.ai is an educational platform designed to help you improve your photography skills. While our AI provides personalized feedback and recommendations, it should not be considered a substitute for professional photography training or advice.
Your success with photography depends on many factors including your dedication, practice, creativity, and individual circumstances. We make no guarantees about the results you will achieve by using our Service.
8.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMAGE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of (or inability to access or use) the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID FOR THE SERVICE (I.E., $49 USD).

You agree to defend, indemnify, and hold harmless Image LLC, its officers, directors, employees, contractors, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:
- Your use of and access to the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Your User Content
- Any harm caused to any third party by your actions
10. Termination
10.1 Termination by You
You may stop using the Service at any time. To delete your account, please contact us at [email protected]. Note that account deletion does not entitle you to a refund unless within the 30-day money-back guarantee period.
10.2 Termination by Us
We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:
- Breach of these Terms
- Violation of our Acceptable Use Policy
- Fraudulent or illegal activity
- Requests by law enforcement or other government agencies
- Extended periods of inactivity

11.3 Jurisdiction
Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Rīga, Latvia. However, if you are a consumer residing in the EU, you also retain the right to bring proceedings in your country of residence.

- Change or remove features from the Service
- Impose limits on certain features or restrict access to parts of the Service

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
13.3 Waiver
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
13.4 Assignment
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
13.5 Language
These Terms are provided in English. Any translations are provided for convenience only. In case of conflict, the English version shall prevail.
